COMMITMENT TO PRIVACY

The following describes American AgCredit’s policy and practices with respect to consumer privacy.

American AgCredit’s approach to privacy begins with our values based upon trust, respect and integrity. Consistent with our tradition of upholding high ethical standards, American AgCredit (“AAC”),[1] is committed to supporting a privacy program that complies with applicable privacy laws and standards for protecting personal information for all customers. As a member of this institution, the privacy and the security of your personal information are vital to our continued ability to serve your ongoing credit needs.

The purpose of this Privacy Policy is to disclose how we collect, use, and share information and how we attempt to safeguard the data you provide to us, including information provided through our website, agloan.com (“website”).[2] We may revise this Policy from time to time. If we make changes to our Privacy Policy, we will revise the “Last Updated” date at the top of this Policy. Any changes to this Policy will become effective when we post the revised Policy on this website. Your use of this website means that you accept the terms of the Privacy Policy in effect at the time of usage.

PROTECTING YOUR PRIVACY

We do not sell or trade our customers’ personal information to marketing companies or information brokers. We limit the use and collection of all information to that which is necessary to maintain and provide financial services, provide high quality service, and offer new products and services that may be of benefit to you.

We hold your financial and other personal information in confidence as required by law. Since 1972, Farm Credit Administration (“FCA”) regulations have forbidden the directors and employees of Farm Credit institutions from disclosing personal borrower information to others without your consent except as otherwise permitted by law. We maintain reasonable security standards and procedures to protect your privacy and help prevent unauthorized access to your personal information. We also incorporate physical and electronic safeguards and make efforts to protect the security of personal information. For additional information on our security measures, please see Security Measures. However, we cannot and do not guarantee complete security, as it does not exist on the Internet.

DESCRIPTION OF COLLECTED INFORMATION

When you contact us or visit our website, we may collect several types of information from and about you, including:

  • Personal information, such as your name, postal address, street address, phone number, mobile phone number email address, account number, geolocation data and any other identifier by which you may be contacted online or offline.
  • Additional information volunteered and/or provided by you during a loan inquiry or service process or other online application used to enable us to offer you the best products and services.

When you visit our website, we automatically collect and store the following information about you:

  • The internet domain (g., company.com) and IP address (a number automatically assigned to your device when using the internet) from which you access our website.
  • The type of browser and operating system used to access our website.
  • The date and time you access our website.
  • The pages visited on the website. The domain of the referring website visited prior to visiting our website.

This information does not identify you personally and is automatically collected and stored through the use of cookies. A cookie is a small amount of text sent from a website to your computer while visiting the site. The cookie is stored on your hard drive. We use discreet information stored in cookies in order to provide a customized user experience. However, you can set your web browser(s) to prevent cookies from being sent. We collect aggregate data about our users through Google Analytics. We use such aggregate demographic and general interest information to better understand our users so that we may provide better online services. We may also collect your personal information from others, such as credit bureaus, affiliates, or other companies in order to offer or provide you with new, better or different services.

HOW PERSONAL INFORMATION MAY BE SHARED

Federal regulations and other authorities allow us to disclose customer information in certain situations. Such situations include:

  • Requests from FCA examiners and our funding bank.
  • Requests from law enforcement agencies or departments of the United States in connection with a legitimate law enforcement inquiry or as permitted or otherwise required in connection with criminal or civil proceedings.
  • Information provided for the confidential use of a Farm Credit institution in contemplation of the extension or administration of credit or the collection of loans.
  • Acting as a credit reference for you with other lenders and providing information to a credit bureau or other consumer reporting agency.
  • Use of real estate appraisal information in connection with an AAC employee’s application with a State licensing agency to become a licensed real estate appraiser after certain personal information has been removed from the appraisal report.
  • Requests from AAC shareholders for permitted use in connection with AAC Director elections and other permissible shareholder communications, provided the shareholder certify in writing that they will utilize the list exclusively for communicating with other shareholders for permissible purposes and not make the list available to any other person other than the shareholder’s attorney or accountant.
  • For the purpose of protecting AAC’s security position, information provided to buyers, warehousemen and others who deal in produce or livestock of the kind that secures such loans as permitted by law.
  • Information disclosed pursuant to your written consent.

In addition, as required by federal laws targeting terrorism funding and money laundering activities, we collect information and take actions necessary to verify the identity of individuals and organizations with whom we do business. Consequently, we reserve the right to disclose any information we deem necessary to comply with any applicable laws, regulations, legal process, or governmental request, including personally identifiable information, to the extent permitted by law.

We also may share your personal information with our third party providers to assist us in providing, improving and/or enhancing our services to you and to our customers generally.

Any disclosure of personal information, including those situations described above, will be made only as permitted by law, including compliance with all applicable state and federal financial privacy laws.

We may offer links to third party websites. While we do our best to provide you with helpful, trustworthy resources, we cannot endorse, approve, or guarantee information, products, services, or recommendations provided by or through a third party website. Because we do not control any third party website, and/or because we may not always know when information on a linked website changes, we are not responsible for the content or accuracy of any third party website. We will not be responsible for any loss or damage of any sort resulting from the use of a link on a third party website nor will be we liable for any failure of products or services advertised or provided on any website that we do not own or control.

We offer links to other sites to you on an “as is” basis. When you visit a third party website by using a link on our website, you will no longer be protected by our Privacy Policy and security practices. The data collection, use, and security practices of the linked website may differ from the practices of our website. You should familiarize yourself with any privacy policy and security practices of the linked website, as those are the policy and practices that will apply to your use of the linked website rather than our policy and procedures in those regards.

CHILDREN’S ONLINE PRIVACY PROTECTION ACT

We comply with the Children’s Online Privacy Protection Act, which is sometimes referred to as COPPA. This website is not directed at children under the age of 13, nor do we knowingly collect personally identifiable information from children under 13. If we learn we have collected or received personally identifiable information from a child under 13 without verification of parental consent or as otherwise permitted by law, then we will delete such information. DO NOT TRACK

There is currently no industry agreed-upon response to a Do Not Track signal.  At this time, the website does not respond differently based on a user’s Do Not Track signal.

NOTICE TO NEVADA RESIDENTS

Nevada law allows Nevada residents to opt-out of the sale of certain types of personal information. We do not sell your personal information. However, if you are a Nevada resident, you may still submit a request to opt-out of sales and we will record your choice. Opt-out requests may be made by contacting us at privacy@agloan.com or by clicking on this Do Not Sell My Personal Information link.

You also may be placed on our internal Do Not Call List by following the directions in the “How to Limit Direct Marketing Contact” section. NOTICE TO CALIFORNIA RESIDENTS

The California Consumer Privacy Act (CCPA) requires that we provide California residents with a privacy policy that contains a comprehensive description of our online and offline practices regarding the collection, use, disclosure, and sale of personal information and of the rights of California residents regarding their personal information.

The CCPA defines “personal information” to mean information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. Personal information does not include information that is publicly available, deidentified or aggregate information. For purposes of this “Notice to California Residents” section we will refer to this information as “Personal Information.”

Right to Know About Personal Information Collected, Disclosed, or Sold

Your Right

If you are a California resident, you have the right to request that we disclose what Personal Information we have collected about you. This right includes the right to request any or all of the following:

  • Specific pieces of Personal Information that we have collected about you;
  • Categories of Personal Information we have collected about you;
  • Categories of sources from which the Personal Information was collected;
  • Categories of Personal Information that we sold (if applicable) or disclosed for a business purpose about you;
  • Categories of third parties to whom the Personal Information was sold (if applicable) or disclosed for a business purpose; and
  • The business or commercial purpose for collecting or, if applicable, selling Personal Information.

The CCPA defines “sell” to mean selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a California resident’s Personal Information to another business or a third party for monetary or other valuable consideration.

Our Process for Verifying a Request to Know

We will comply with your request upon verification of your identity and, to the extent applicable, the identity of the California resident on whose behalf you are making such request.  Our verification process will be conducted through authentication practices initiated at the time of your request as follows:

Request to Know Categories of Personal Information: We will verify your identity to a “reasonable degree of certainty” by verifying at least two data points which we have determined to be reliable for the purpose of verifying identities.

Request to Know Specific Pieces of Personal Information: We will verify your identity to a “reasonably high degree of certainty” by verifying at least three pieces of Personal Information which we have determined to be reliable the purpose of verifying identities.

In addition, you will be required to submit a signed declaration under penalty of perjury stating that you are the individual whose Personal Information is being requested.

Collection of Personal Information

American AgCredit collects individual identifier, protected classification, commercial, biometric, network activity, geolocation, electronic, visual, professional, employment-related, education and consumer profile information for a variety of business purposes, including to make credit decisions, provide financial and other services to our customers, prevent fraud, service accounts, perform marketing, comply with legal and regulatory obligations, improve the quality of our services, and to secure our assets and those of our customers.

We comply with requests for information from law enforcement and regulators provided the requests comply with applicable laws and regulations. Therefore, we may share your information with authorized issuers of subpoenas, summons, search warrants, levies and similar legal processes.

We may also disclose your information to a third party to enforce our agreements and policies or protect the security of American AgCredit and its customers.

The following table presents the categories of Personal Information that we have collected, the categories of sources from which that information was collected, and the categories of third parties with whom we shared that Personal Information for the 12 months preceding the Effective Date of this Privacy Policy.

  • Identifying Information and Financial Information, which might also contain protected classifications, commercial information and/or professional or employment-related information.
  • Identifying information and network activity information.
  • Identifying and consumer profile information about customer prospects and leads.

  • Account Opening and Servicing Processes with you; Other Financial Institutions with whom you have a relationship; Credit Reporting Agencies.
  • Visitors to our online and mobile websites and users of our mobile applications.

Business or Commercial Purpose for the Collection

  • Deliver financial services to you, including making credit decisions, originating and servicing loans, and providing leases and crop insurance; Respond to customer inquiries; Prevent fraud; Comply with legal and regulatory obligations; and for Marketing purposes.
  • Provide a personalized digital experience, authenticate users, comply with legal and regulatory obligations, prevent fraud, detect and respond to security incidents, for marketing purposes, and to deliver information to prospective and current customers.
  • Marketing purposes.

Categories of Third Parties with whom We Shared Personal Information in the 12 month period preceding the Effective Date of this Policy

  • Regulatory examiners and our funding bank;

Disclosure or Sale of Personal Information

The following is a list of categories of Personal Information that were disclosed to third parties for a business or commercial purpose in the preceding 12 months:

  • Online identifying and network activity information obtained from visitors to our website.

We do not sell the Personal Information of minors under 16 years of age without affirmative authorization.

Right to Request Deletion of Personal Information

Your Right

If you are a California resident, you have the right to request that we delete the Personal Information about you that we have collected or maintain. However, a business is not required to comply with a request to delete if it is necessary for the business to maintain the Personal Information in order to, for example, complete a transaction, detect security incidents, comply with a legal obligation, or otherwise use the Personal Information, internally, in a lawful manner that is compatible with the context in which the consumer provided the information.

If you submit a request to delete online, you will be asked to confirm separately that you want your Personal Information deleted.

Our Process for Verifying a Request

We will verify your identity either to a “reasonable degree of certainty” or a “reasonably high degree of certainty” depending on the sensitivity of the Personal Information and the risk of harm to you by unauthorized deletion.

We will verify your identity to a “reasonably high degree of certainty” by verifying at least three pieces of Personal Information which we have determined to be reliable the purpose of verifying identities. In addition, you will be required to submit a signed declaration under penalty of perjury stating that you are the individual whose Personal Information is being requested.

If we are unable to verify your identity to the applicable standard, we will treat your request to delete as a request to opt-out of the sale of the personal information that you provided as part of processing the request to delete.  See the following section for a description of the right to opt-out of the sale of personal information.

Your Right

If you are a California resident, you have the right to direct a business that sells (or may in the future sell) your Personal Information to stop selling their Personal Information and to refrain from doing so in the future.

How We Process a Request to Opt-Out

The CCPA does not require that we verify the identity of individuals who submit requests to opt-out of sales. However, we may deny the request if we have a good-faith, reasonable, and documented belief that the request is fraudulent. If we deny the request on this basis, we will notify the requesting party and provide an explanation why we believe the request is fraudulent.

Right to Non-Discrimination for the Exercise of a California Residents Privacy Rights

We will not discriminate against California residents if they exercise any of the rights provided in the CCPA as described in this section “Notice to California Residents.” As such, we will not deny goods or services to that California resident; charge different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties; provide a different level or quality of goods or services to the California resident; or suggest that the California resident will receive a different price or rate for goods or services or a different level or quality of goods or services. However, we are permitted to charge a California resident a different price or rate, or provide a different level or quality of goods or services, if that difference is reasonably related to the value provided to us by the individual’s data.

Authorized Agents

California residents may use an authorized agent to submit a request to know, delete, on your behalf.

If you use an authorized agent to submit a request to know or request to delete, we may require that (1) the authorized agent provide proof of your written permission (2) that you verify your identity directly with us. These requirements do not apply if you have provided the authorized agent with a power of attorney pursuant to California Probate Code sections 4000 to 4465.

If you use an authorized agent to submit a request to opt-out of sales, you will need to provide that authorized agent with written permission to do so and submit written proof to us that the agent has been authorized to act on your behalf.

Shine the Light Law

We do not disclose Personal Information obtained through our Site or Services to any non-affiliated companies for their direct marketing purposes.
